Xiaomi is in Trouble for Illegal Patent Use of Huawei Camera Technologies and 4G

Some few days ago, Chinese tech Giant Huawei sued its home competitor Xiaomi for illegal patent use. Huawei presented this case to the Chinese Intellectual Property Office who in-turns, accepted the litigation. Huawei has a lot of patents across the globe that it claims are illegally being used. The Chinese tech company has promised to crackdown on all companies using its patents illegally. The fact that the Chinese Intellectual Property Office has accepted Huawei’s case is a steppingstone to taking legal actions against these companies.

The latest announcement came through the Administrative Judgements at the Chinese Intellectual Properties Office. The announcement states that “On January 17, 2023, the Chinese State Intellectual Property office accepted the case filed by Huawei against Xiaomi for infringing its four patents. The four patents are:

• Method and device for sending control signaling.
• Method for feeding back ACK/NACK information during carrier aggregation, base station, and user equipment.
• Method and devices for obtaining panoramic images.
• A lock screen method and mobile devices.

It also mentioned that Huawei’s case against Xiaomi has to do with illegal use of Patent for 4G or LTE technology. These patents are Standard Essential Patents (SEP). The next case is about smartphone camera and device unlock technology, which are non-SEP.

Yu Issued a Statement About Illegal Use of Huawei Patents

Last year, the CEO for Huawei Consumer Business Group and Executive Director Yu Chengdong made a statement with regards to illegal patents use of some companies. He said some companies are continuously copying Huawei in both design and features. He explained that these companies are using Huawei’s patents and have refused to pay. The worst part is that these companies are claiming ownership of Huawei’s patents.

This act is a very embarrassing one for the smartphone industry as a whole. Every tech maker has the full right to protect its intellectual properties and preserve its integrity. Research and development require a lot of hard work and dedications and every company has the right to protect its properties.

Huawei Sues Xiaomi: Xiaomi Responds to this Issue

Finally, Xiaomi has come out to respond to this matter. It says that both parties are currently negotiating for patent licensing.  The IP Protection system in China has various forms of resolution processes for such patent disputes. Xiaomi said they are both (Huawei and Xiaomi) aware that intellectual property licensing and cooperation are conducive to promoting innovations and the interest of the general public. According to the response from Xiaomi, there is an ongoing negotiation to reach an agreement on this issue.
