According to an announcement made by the InterDigital firm, Huawei has filed a lawsuit in China against the U.S. company, which is now preparing its defense. The Chinese Behemoth accuses the U.S. firm of failing to negotiate a new agreement to license its standards essential patents on a Fair, Reasonable and Non-Discriminatory basis. The Standards Essential Patents are a special type of patent that need to be licensed by manufacturers to make sure that their product meets a technical standard.

According to the lawsuit, which was filed early in this month, the patents involved in this case are related to 3G, 4G and even 5G wireless tecnologies. The document was filed Shenzhen Intermediate Peopleās Court. Huawei is asking the court to determine how much InterDigital will need to pay in royalties to cover the wireless technologies involved in the case from 2019 to 2023.
Companies will need to be more careful with the indiscriminated use of such patents, and unfortunately for InterDigital it will serve as exemple for future companies that are intending to use any of the wireless technologies from Huawei. The Chinese company is currently the global leader in networking equipmentl, and with the advent of 5G this scenario won’t change anytime soon.
